The Protection of Employee (Temporary Agency Work) Act 2012 signed into law 16.05.12

17th May, 2012.

NOTICE TO MEMBERS

TO:    AGENCY NURSE/MIDWIFE MEMBERS

Dear Colleagues,

The Protection of Employee (Temporary Agency Work) Act 2012 was signed into law on Wednesday 16th May 2012 and accordingly has now become the Law in respect of protection of employees working via a temporary agency.  As you are aware, the Minister for Jobs, Enterprise and Innovation, Richard Bruton, in announcing the intent to introduce legislation, confirmed that the directive relating to this matter would be implemented as and from the appropriate date of 5th December 2011 and this is confirmed in legislation passed.

It is now extremely important that you seek immediate confirmation from your Agency employer that your incremental credit will be corrected to reflect the December date.  If this has not been done within the next fortnight, you should immediately contact your Industrial Relations Officer for the Irish Nurses and Midwives Organisation, as we will then lodge claims on your behalf to have this paid to  you in accordance with the agreement for Nurses/Midwives calculating incremental credit.

Please do not hesitate to contact your local Industrial Relations Officer in respect of this matter and/or our Information Office or the undersigned.

Thanking you for your attention to this matter.

Is Mise,

PHIL Ni SHEAGHDHA,
Director of Industrial Relations.
