Implementation Of Emergency Department Agreement

Workplace Relations Commission Fifth Review

Dear Colleagues, 

The Workplace Relations Commission (WRC) undertook its fifth review, of the national ED Agreement between INMO/Department of Health/HSE earlier today.

This meeting was attended by ED nurse representatives from a number of hospitals, together with full-time officials, including myself, of the Organisation.  The management side was led by Mr. Liam Woods, Director of Acute Services, together with other senior officials from the Department of Health/HSE.

At this meeting the INMO raised a number of issues including:

  • the reality that  the number of patients on trolleys had reduced, within the Dublin area, but the situation continued to deteriorate in a number of hospitals outside of Dublin;
  • there continued to be delays and prevarication, by a number of hospitals, with regard to the filling of posts established under the Agreement;
  • there continued to be an absence of senior clinical decision makers, in some hospitals, out of hours and at weekends, and this needed to be addressed;
  • much greater progress needed to be made with regard to cross-consultant discharge/delegate discharge to assist with patient flow;
  • the need for the security reports, required under the agreement, to be made available to the INMO; and
  • that the ED Expert Group, on Staffing, had now issued its report and this report will be considered, as provided for under the terms of reference, by a high level group, including:
    • -    Ms. Teresa Cody, Head of HR, Department of Health;
    • -    Mr.  Liam Woods, Director of Acute Services; and
    • -    Mr. Liam Doran, General Secretary, INMO;

at a meeting next Tuesday, 6th September 2016, at 3.30 p.m.  The full text of this ED Expert Group Report on Staffing can be accessed here.  

A further update will issue after the meeting next Tuesday, 6th September 2016.

Arising from this fifth review, today (Friday, 2nd September 2016), which lasted over three hours, the following can be stated:

1.    The management side reaffirm its absolute commitment to the implementation of all elements of the ED Agreement.

2.    In relation to the filling of posts, established under the agreement, it was confirmed that all outstanding matters would be addressed on or before 9th September 2016 (one week).

3.    A specific issue has arisen with regard to the commencement, of a consultancy project regarding patient flow in University Hospitals Galway and Limerick.

It is agreed that the next step in this process will be a full briefing, of members locally, at the next hospital level meeting, required under the agreement, and this will provide for:

  • full details on what is proposed;
  • opportunity to input into what is proposed; and
  • a commitment that all analysis, from the project work, will be brought back to the hospital fora established under this ED Agreement for further consideration.

4.    The WRC will undertake a further review, of the implementation of this agreement, on Friday, 21st October 2016, at 10.30 a.m. 

In tandem with all of the foregoing all of the meetings, at hospital and group level, continue to ensure all aspects of the agreement are implemented locally.  We would encourage members to continue to utilise these local fora to insist on full implementation of the National Agreement as, where the agreement has been implemented, we are now seeing improvements.
